Якщо підходити до проблеми смертної кари саме з позицій юриста та з

точки зору логіки кримінального права, то її вирішення ніби не становить

особливих труднощів. Оскільки йдеться про один із видів покарання, тобто, як і

будь-який інший вид, але ця найвища міра покарання має відповідати

загальним цілям покарання, сформульованим у законі, та основним природнім

правам людини. Так, смертна кара з точки зору противників проти неї

суперечить Основному закону, тобто Конституції. Адже встановлюючи на

своїй території смертну кару, держава не тільки відбирає життя у людини, вона

при цьому вона заперечує честь та гідність, соціальну цінність людської істоти

як мети існування держави та суспільства [7, c. 203].

Визнаючи абсолютну цінність життя людини, ставлення до неї як до

універсальної свідомої істоти, можна зробити висновок, що з позицій

загальнолюдської й переродженої, гуманізованої суспільної моралі смертна

кара є кроком назад в еволюції суспільства. Досліджуючи дану проблематику

можна й надалі розширено вивчати та аналізувати суть покарання у вигляді смертної кари в різних правових системах світу.
